Llogara Tunnel tender (SH8 Vlorë-Sarandë, Orikum-Himarë section)
Status: Under investigation. Balluku indicted (reported 31 Oct 2025). Immunity not lifted (12 Mar 2026). No trial verdict found.
Summary
The Llogara Tunnel is a 5.99 km road link on the southern coast, reported at about 190 million euros. The tender was reopened on 22 June 2021 after an earlier round was annulled. A consortium of Intekar Yapi and ASL Insaat won, according to 2021 reporting. SPAK alleges that Balluku, together with Evis Berberi and several commission members, predetermined the winner and gave unfair advantages to a consortium. The Democratic Party raised cost concerns in 2021 and said the winning offer was higher than the rival bid. Balluku denies wrongdoing.
In November 2025 the GJKKO court suspended Balluku and placed two officials under house arrest. In 2026 parliament declined to lift her immunity. The case is at the investigation stage in the sources reviewed; no trial verdict was found.
Several allegations rest on messages reported from the SPAK file. The exact content, dates and authenticity of those messages have not been tested in court.

Open questions (4)
- Primary SPAK indictment text and the exact list of charges have not been retrieved.
- Authenticity and context of the Signal and other messages reported from the file.
- Whether the 2026 further procurement accusations (reported 7 Aug 2026) overlap with the Llogara tender or are separate procedures.

Llogara first tender cancelled after ministry instruction (as reported)
Exit News (1 Dec 2025, fetched) reports that around 17 March 2021 Balluku and Berberi concluded the leading bid was non-compliant, and that Balluku ordered cancellation, which the evaluation committee carried out (the source gives 'about' 17 March). Balkanweb (20 Nov 2025, fetched) quotes a Balluku message from the SPAK file, undated and from the first tender: 'I think we should cancel it. Disqualify everyone.' (translated from 'Mendoj ta anulojmë. Skualifikoi të gjithë'). Both are SPAK file excerpts as reported by the press.

Llogara re-tender: five bids opened; messages on the result (as reported)
Exit News (fetched) reports five bids for the re-announced Llogara tender (re-announced 21 June 2021; deadlines extended to 7 Sept 2021). The İntekar–ASL joint venture bid about 190 million euros, the second-lowest; the lowest was about 10 million less (Exit's figure). Balkanweb (20 Nov 2025, fetched) lists bidders including a Chinese bidder, Limak, Albbuilding and others, with bid figures in units the article does not make consistent, so those figures are not used here. Messages attributed to Balluku on 7 Sept 2021, as translated by Exit: 'In brief, it appears we're doing excellent!' and 'Of course some idiot went lower, but surely they don't meet the criteria'. Exit gives translations; the source language is not stated.

İntekar–ASL announced as Llogara tender winner (Exit News account)
Exit News (1 Dec 2025, fetched) states the İntekar–ASL joint venture (İntekar Yapı Turizm Elektrik İnşaat Sanayi Ticaret Ltd. Şti. and ASL İnşaat Taahhüt ve Sanayi Ticaret Ltd. Şti.) was announced as winner on 26 Sept 2021. SPAK, as reported by Balkanweb (20 Nov 2025, fetched), says the consortium did not meet key legal and technical requirements. Balkanweb also reports a separate account, that Hill International N.V. and Net-Group won in March 2022 (see ev-2022-03-llogara-alternative-award-reported). The two accounts are not reconciled in any source.

Balkanweb publishes Balluku-Berberi message excerpts from the SPAK file (Signal headline)
Balkanweb (20 Nov 2025, fetched) publishes message excerpts it says come from the SPAK file and from the phone of Evis Berberi (former ARRSH director). The headline refers to Signal; the body describes the phone as a BlackBerry and does not say which platform each message used. Excerpts attributed to Balluku include 'I think we should cancel it. Disqualify everyone.' (translated from 'Mendoj ta anulojmë. Skualifikoi të gjithë') and 'And the bids?' (translated from 'Po ofertat?', 7 Sept 2021). Excerpts attributed to Berberi include 'The first with the second, a 10 million euro difference, a super summary' (translated from 'I pari me të dytin 10 milion euro diferencë super fare përmbledhje'; 7 Sept 2021). Translations are from the article. A Shqiptarja search summary says some messages were found on a phone seized from Balluku; this conflicts with Balkanweb and is not resolved. Authenticity and chain of custody were not tested in any source reviewed. Neither Balluku's nor Berberi's response to these specific messages was found.

GJKKO reasoning: suspension of a minister permitted under Article 242
Shqiptarja's reporting of the court reasoning quotes Article 242(2) of the Criminal Procedure Code: 'Kjo masë nuk zbatohet ndaj personave të zgjedhur sipas ligjit elektoral' (translation: 'This measure does not apply to persons elected under the electoral law'). The court reads this as excluding only deputies, mayors and council members, so suspension is allowed for a minister. It states: 'Në rastin konkret, për të pandehurën Belinda Balluku, nuk ka ndalim ligjor' (translation: 'In this specific case, for the defendant Belinda Balluku, there is no legal prohibition'). Judge named as Erion Çela. Translations are mine.

Three judges dissented: Asim Vokshi, Ilir Toska and Marsida Xhaferllari (Shqiptarja). The Constitutional Court decision number is not stated (the PDF is named only by date, 'Vendim-date-12.12.2025'). A search summary citing a Shqiptarja analysis reports the Constitutional Court split 4-4 on the government's request to annul the GJKKO suspension, so the request was not accepted (majority of five not reached). A separate Shqiptarja headline reports 'Belinda Balluku kthehet në detyrë' (Balluku returns to duty), which conflicts with the 4-4 account. Other search summaries mention a 12 December 2025 interim decision by 5-3. These accounts conflict and were not verified against the Court's published decisions.

Rama's quoted sentence (translation mine): 'grupi parlamentar socialist do të angazhohet për zgjidhjen përmes ndërhyrjes në legjislacion' (the Socialist parliamentary group will commit to resolving it through legislative intervention).
